A patent gives the inventor of a new and unobvious invention the right to exclude others from using the invention. The duration for which the inventor receives the right to exclude others from the use of the invention depends on the type of patent obtained. Utility and plant patents bestow the exclusive right for a period of 20 years from the filing date of the application whereas a design patent expires 14 years from the filing date of the invention.
