Child custody refers to the care and control of minor children as awarded by the Courts to a Parent or both Parents (otherwise known as custodial parent), through a legal proceeding or resulting from an agreed custody arrangement. A custodial parent(s) has the responsibility for the child’s care and upbringing, as well as the decision making rights regarding the child’s health, education, religion and extracurricular activities. In awarding custody, the Courts would typically consider the best interest of the child, including the child’s wishes, the child’s relationship with each parent, the parents and family’s health, and the child’s health and well being. After consideration of the above, the Courts may then decide to award either a joint custody where both parents share equal responsibility for the child’s care and upbringing or sole custody where only one parent has the sole responsibility for the child’s care and upbringing. To avoid any long drawn-out custody battle and spare the child the trauma that such custody battle may create, it is always preferable to reach an agreement concerning custody arrangements for a child so as to avoid the court having to render a decision in awarding child custody.

At Noorani & Villar, we provide full services for child custody matters for Client’s including negotiating a joint custody arrangement with the other spouse or significant other for decision making rights regarding the child’s health, education, religion and extracurricular activities, etc., or a pseudo-joint custody arrangement where one spouse has actual custody but the other spouse also retains some decision making rights.
