Injuries caused while Birth can have serious and permanent consequences on a child. Injuries during childbirth can be caused by the negligence of the doctor. There is about a 7 in 1000 chance that every baby born will be injured during the process of childbirth.

 When do injuries during childbirth amount to Medical Malpractice?

A doctor’s actions and lack of response to the indications of a fetal monitor during surgery can rise to medical negligence and malpractice. Birth is a trying experience for a baby. It is important that the baby be positioned correctly during childbirth. If the position is not ideal or the umbilical cord wraps around the baby’s neck, the fetal monitor will indicate the distress the baby feels. The doctor should act immediately to the fetal monitor. Failure to do so can result in the baby suffering brain damage during birth. Babies with brain damage suffer from a condition called cerebral palsy.

When tests indicate a breech position or that the fetus is larger than the average fetus, there is a higher risk that the baby will be born with Brachial Plexus or Erb’s Palsy. Erb’s Palsy is a condition caused by injuries sustained during birth where the child will suffer nerve damages in the shoulder and will lose the ability to rotate the lower arm.
